1. WEBSITE OWNER

This website is the responsibility of María del Mar Liñán Coca with NIF 74728783N, a company domiciled at C/Capitán Luque, 9, Motril, Granada, 18600,] (hereinafter, “MotrilTour” or “The Entity”).


2. MOTIVATION

The Entity respects the privacy rights of its Users and recognizes the importance of protecting the personal data that the Entity collects about its Users.

The purpose of this document is to inform website users about the processing of personal data carried out on the website.


3. PERSONAL DATA PROCESSED BY MERE ACCESS TO THE WEBSITE

By simply accessing the website, the Entity collects the IP address and other data relating to the connection and its origin. The IP address is a code that identifies the User's internet connection at a specific time. Only the User's internet service provider can identify the subscriber assigned a particular IP address at a specific time. Due to the nature of the server that hosts the website, the User's IP address is automatically logged along with the date and time of access.

This data is used solely to manage normal website usage and to perform statistical analysis of website usage.

The Entity does not provide this information to any third party, unless it is required to do so by current legislation (for example, an official request in the context of a police investigation).

The legal basis that legitimizes the processing of the IP address is the technological need to enable the provision of the website.

IP addresses will be retained for a period of 1 month.


4. PERSONAL DATA PROCESSED WHEN MAKING A RESERVATION

  • Data processing by the payment service provider

If the User books their tour through the channels indicated in the booking process, their card details will be automatically provided to the payment service provider to process the corresponding charges for this booking. The payment service provider will retain the card details for a limited time, solely for the purpose of collecting any additional charges that may arise, as outlined in the booking Terms and Conditions (such as booking extensions, modification or cancellation fees, etc.).

MotrilTour will not store the User's card details; these will be stored securely by the payment service provider in accordance with its specific regulations. In this regard, the Entity will only process confirmation of whether the user has paid for the reservation or any additional charges, as well as the bank card token (a specific code linked to the card, but which does not allow its use) to request the provider to process the additional charges. The legal basis for this processing is the necessity for the performance of the contract.

  • Booking management and contracted services

To manage the booking requested by the User, MotrilTour must process the personal data that the User provides through the data collection form.

Similarly, the Entity will process the information necessary to manage requests for modification or cancellation of reservations requested by the User.

In the event that, in free writing fields or through direct request to the Entity, the User provides data relating to their health in order to manage specific services, MotrilTour understands that such data is communicated expressly and voluntarily by the User, since there is no prior request for this information and it will only be processed to manage the User's request (for example, services adapted based on special needs).

Furthermore, the Entity will process the reservation data in compliance with accounting, legal, tax and administrative obligations

The legal basis for these treatments is the need for the execution of the contract.

  • Claims Management

To manage any claims that the User may file in relation to the services contracted by the User, MotrilTour will receive the information relating to the claim generated, in order to process said claim and be able to offer an appropriate solution to the User.

In this case, if the claim is due to compensable damages suffered by the user, the Entity will communicate this information to the contracted insurance entity in order to manage the claim suffered by the User.

The legal basis for these treatments is the need for the execution of the contract.

  • Handling inquiries and other requests

MotrilTour will process the data necessary to address the query or request submitted by the User through the various channels provided for this purpose. The legal basis for this processing is the User's consent, understood as having been given voluntarily when submitting the query.

  • Online reputation monitoring

MotrilTour may check user reviews on websites such as TripAdvisor and similar platforms to monitor its online reputation and make informed business decisions for the continuous improvement of its services. In the event of negative experiences, MotrilTour may contact users to propose possible solutions. The company believes it has a legitimate interest in improving its services and protecting its brand online, as well as in resolving claims and complaints submitted through websites like those mentioned.

  • Judicial or administrative procedures

In the event of any legal or administrative proceedings that may arise from services offered or provided by MotrilTour, the company will process the information necessary to present appropriate arguments, exercise its right of defense, or file any claims it deems appropriate based on the facts of the case. The legal basis for this processing is legal obligations established by administrative regulations (primarily the Common Administrative Procedure Act) or the need for the company to exercise its legitimate right to effective judicial protection, both in its right of defense and in filing any legal claims it deems appropriate, based on the Civil Procedure Act or the Criminal Procedure Act.

The personal data accessed will be processed and stored for as long as the contractual relationship or the purpose for which it was collected remains in effect. After this period, the Data Controller will retain the personal data, duly blocked, once the contractual relationship has ended or when the data is no longer relevant for the purposes for which it was collected. This data will be made available to the competent Public Administrations, Judges and Courts, or the Public Prosecutor's Office for the limitation period of any actions that may arise from the relationship with the user and/or the legally established retention periods. The Data Controller will proceed to the physical deletion of the data once these periods have expired.

If the User has given their consent for the purposes of the processing informed in this clause, MotrilTour will keep their information as long as the User does not withdraw the consent initially given, through the means indicated in the following section.


4.1 Who will your data be shared with?

  • Online payment service providers whose systems are connected to the MotrilTour website, in order to collect the booking fee and any additional charges.
  • Insurance brokerage and/or insurance company of MotrilTour in case the User suffers a compensable loss.
  • Competent Public Bodies, Judges and Courts.
  • Service providers who have access to customers' personal data and process said data on behalf of and for the Controller as a result of their provision of services. Specifically, MotrilTour will contract the provision of services from third-party providers who operate in, but are not limited to, the following sectors: legal advice, multidisciplinary professional services firms, technology service providers, and IT service providers.


5. OTHER PROCESSING OF PERSONAL DATA

5.1. Cookies and similar

The Entity uses cookies and other similar mechanisms for storing and retrieving data on terminal equipment (hereinafter, “Cookies”).

Cookies are files that are downloaded to the User's browser and can be read later by the Entity. In this way, cookies enable various functionalities, such as recognizing a User who has previously accessed the website and allowing for analysis of website usage to improve it.

However, it is not possible to ascertain the User's identity from the cookies used by the Entity, unless the User provides additional information through other means and these could be linked to the Cookies they have downloaded.

5.2. Contact form:

MotrilTour will process the data provided through the contact form in order to respond to the contact request or inquiry.

· Legal basis: The legal basis that legitimizes the processing is the user's consent expressed at the time of sending their contact request.

  • Retention period: Data will be processed for the time necessary to resolve the user's contact request. Afterwards, it will be blocked and stored for 3 years to address any potential liabilities arising from the processing.

    MotrilTour will process the data provided through the booking form in order to manage and control the fulfillment and development of your purchase and thus provide you with an adequate provision of services.

    · Legal basis: The legal basis that legitimizes the processing is the execution of a contract.

  • Retention period: The data will be processed for the time necessary to provide the contracted service. Afterwards, it will be blocked and stored to address any potential liabilities arising from the processing.

    6. WHAT RIGHTS DOES THE USER HAVE AND HOW TO EXERCISE THEM

    Data protection regulations guarantee Users the following rights:

    · Access: Allows the User to know what information is held, where it was obtained from, to whom it has been provided and for what uses it has been processed.

    · Rectification: Allows the User to rectify any erroneous or outdated data.

    · Deletion: Allows the User to stop the processing of their data.

    · Opposition: Allows the User to stop using their data for a specific purpose.

    · Limitation: Allows the User to restrict the processing of their data, but in such a way that they are kept for some later purpose.

  • Portability: Allows the User to obtain a copy of their data in electronic format and, in certain circumstances, request that it be transferred to another service provider. This only applies to automated processing carried out with the User's consent or for the performance of a contract.
  • · Revocation of consent: Allows the User to withdraw the consent that, where applicable, they have given for the processing of their data.

    These rights require the ability to identify the User requesting them and to link their identity with the data processed by the Entity.

    However, the Entity cannot establish this link with any of the data it processes by the mere access to the website, unless the User can provide certain documentation that allows their identification (for example, a certificate from their Internet access provider indicating the IP address that the User had assigned on a specific date and time).
